Resumen

The main objective of this paper is to argue that the organic design of constitutional courts impacts the legitimacy of constitutional justice. The method used has been to analyze the organic and procedural innovations that have originated in the constitutionality control systems of Latin America, related to the integration system of constitutional courts, amicus curiae, public hearings within the constitutionality control process and publicity of the particular votes and preventions in the constitutionality sentence from a deliberative perspective. The conclusion and main result of the article is that the incorporation of deliberative institutional forms of organization offers new elements to face the countermajoritarian objection to constitutional jurisdiction, strengthening its legitimacy and adherence to the constitutional system as a whole.
