Abstract

This paper addresses the delimitation of the right of access to information of public interest in Chile and compliance with international standards, in terms of transparency and data protection of individuals deprived of liberty. The foregoing, based on the analysis of the Decisions of the Chilean Council for Transparency, between 2009 and 2021, in the face of requests for access to information related to procedures and sanctions. With this, we seek to highlight the main weaknesses of the Chilean regulation on transparency and control of personal data of a group especially protected by law, noting opportunities for improvement considering standards established by international law.
